EULA - End User License Agreement

By downloading or using SitePad Pro(tm), you indicate your agreement to the terms of this license agreement. If you do not agree to the terms herein, you are not authorized to use SitePad Pro and must destroy all copies obtained by you. SitePad Pro is licensed, not sold.

SitePad Pro is owned by Modelworks Software and its suppliers and is protected by United States copyright laws and international treaty provisions. Except to the extent expressly licensed herein, all rights are reserved to Modelworks Software and its suppliers. You may not rent, lease, sell, sublicense, assign, or otherwise SitePad Pro or any of its components. You may not reverse engineer, decompile, or disassemble SitePad Pro or any of its components. Modelworks Software and its suppliers shall retain title and all ownership rights to SitePad Pro and its components.

DISTRIBUTION. You may copy and distribute the demonstration version of SitePad Pro provided that this license agreement and all other files included with the copy. You are prohibited from charging, or collecting a fee, for any such copies. You are also prohibited from distributing SitePad Pro evaluation with any other products without prior written permission. RESTRICTED RIGHTS: Use, duplication or disclosure by the US government is subject to the restrictions as set forth in subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer Software Clause as DFARS 252.227-7013 and FAR 52.227-19.

NO WARRANTIES. To the maximum extent permitted by applicable law, Modelworks Software and its suppliers expressly disclaims any warranty for SitePad Pro and its components. SitePad Pro and related files are provided AS IS without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose. The entire risk arising out using SitePad Pro remains with you.

LIABILITY. Modelworks Softwares entire liability and your exclusive, at Modelworks Softwares option, shall be the cost of Pro or its replacement with another copy of SitePad Pro. To the maximum extent permitted by applicable law, in no event shall Modelworks Software or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or inability to use this Modelworks Software product, even if Modelworks Software has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

GOVERNING LAW. The laws of the State of Washington shall govern this agreement.
